Acceptance of terms

By accessing or using the E-BON platform (e-bon.ro), operated by Crisposoft SRL, you agree to be bound by these Terms and Conditions. If you do not agree to these terms, you may not use the platform.

Service description

E-BON is a fiscal infrastructure platform that provides API-based access to fiscal device management, receipt issuance, reporting and ANAF compliance services. The platform acts as a middleware layer between your POS system and AMEF-certified cash registers.

User obligations

As a user of E-BON, you agree to:

• Provide accurate and complete registration information
• Maintain the security of your account credentials and API keys
• Use the platform in compliance with Romanian fiscal legislation
• Not use the platform for any unlawful purpose
• Not attempt to disrupt, overload or compromise the platform's infrastructure

Billing and payments

Paid plans are billed monthly or annually as selected. Prices are displayed in Romanian Lei (RON) and include VAT where applicable. We reserve the right to modify pricing with 30 days' notice. Refunds are handled on a case-by-case basis.

Limitation of liability

E-BON is provided "as is" without warranties of any kind. Crisposoft SRL shall not be liable for any indirect, incidental or consequential damages arising from the use of the platform. Our total liability is limited to the amount paid by you in the 12 months preceding the claim.

Termination

Either party may terminate the agreement at any time. Upon termination, your access to the platform will be revoked. We will retain fiscal data for the legally required period. You may request export of your data before termination.

Governing law

These terms are governed by the laws of Romania. Any disputes shall be resolved by the competent courts in Romania.

Changes to terms

We may update these terms from time to time. We will notify registered users of material changes via email at least 30 days before they take effect.

Intellectual property

All intellectual property rights in the E-BON platform, including but not limited to software, design, trademarks and documentation, are owned by Crisposoft SRL. You retain full ownership of your fiscal data and any content you upload to the platform. Your use of the platform does not grant you any rights to our intellectual property beyond what is necessary to use the service.

Data processing agreement

For B2B customers who process personal data through the E-BON platform, a Data Processing Agreement (DPA) is available upon request. In this context, E-BON acts as data processor for your fiscal transaction data, while you remain the data controller. To request a DPA, contact us at contact@e-bon.ro.

Service availability

The E-BON platform is provided on a best-effort basis. We do not guarantee a specific uptime percentage at this stage. We strive to maintain high availability and will communicate scheduled maintenance windows at least 24 hours in advance via email and in-platform notifications.

Force majeure

Neither party shall be liable for any failure or delay in performing its obligations under these terms where such failure or delay results from events beyond reasonable control, including but not limited to natural disasters, war, terrorism, pandemics, government actions, power failures, internet outages or third-party service failures.

Severability

If any provision of these terms is found to be invalid, illegal or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable.

Entire agreement

These Terms of Service, together with the Privacy Policy, constitute the entire agreement between you and Crisposoft SRL regarding your use of the E-BON platform. They supersede any prior agreements or understandings, whether written or oral.
